Description of service
NWAobits.com is an online obituary publishing platform serving Northwest Arkansas. We allow funeral homes and families to publish, manage, and share obituaries through our website.
Accounts
To post an obituary, you must create a funeral home account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information when registering.
We reserve the right to suspend or terminate accounts that violate these terms.
Content guidelines
By submitting content to NWAobits.com, you represent that:
- You have the right to submit and publish the content, including all photographs
- The content is accurate to the best of your knowledge
- The content does not violate any applicable laws or third-party rights
- The content does not contain false, defamatory, or harmful information
We reserve the right to refuse, edit, or remove any content that violates these guidelines or that we deem inappropriate, at our sole discretion.
Payments and refunds
Payments are processed securely through Stripe. All fees are listed on our pricing page. Fees are non-refundable once an obituary has been published, except where required by law. If you believe a charge was made in error, please contact us.
Subscription plans (monthly or annual) may be cancelled at any time. Access continues until the end of the paid billing period.
Intellectual property
You retain ownership of all content you submit. By submitting content, you grant NWAobits.com a non-exclusive, royalty-free license to display, distribute, and archive that content as part of our service.
The NWAobits.com name, logo, and website design are our property and may not be used without permission.
Permanent listings
Published obituaries are intended as permanent memorials. We make reasonable efforts to maintain the availability of published obituaries indefinitely. However, we do not guarantee perpetual availability and reserve the right to modify or discontinue the service.
Limitation of liability
NWAobits.com is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
Modifications to terms
We may update these Terms from time to time. We will post the updated Terms on this page with a revised date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the State of Arkansas, without regard to conflict of law principles.
